Q
Am I entitled to holidays and when can I take them?
A
Annual Leave payments are made in line with the Working Time Regulations.
Your attention is drawn to the Terms of Engagement under which all workers are engaged at Relay Recruitment. Clause 5.2 provides for:
For the purposes of calculating entitlement to leave under this clause, the leave year coincides with hte tax year, the current leave year runs from 31st March 2008 - 29 March 2009.
Entitlement to such leave will accrue pro rata from the Temporary Worker’s first working day. Pay for leave taken will be calculated by reference to the Temporary Worker’s average remuneration over the preceding 12 week period or appropriate if the Temporary Worker has completed less than 12 weeks service.
The Regulations require that any annual leave taken has been accrued. You are required to give twice the amount of notice than that of your intended absence. IE 2 days leave will require 4 working days notice. Payments of Annual Leave cannot be carried over from one leave year to another neither can annual leave payments be made in lieu.
Entitlement equates to 8.33% of your basic earnings over a reference period in Relay Recruitments case, 12 weeks.
